Justice David Prosser of Wisconsin; ethical goblin

The state of Wisconsin presented David T. Prosser, Jr. with a law license in 1968 after he graduated from the University of Wisconsin Law School.

In 1998, former Gov. Tommy Thompson was duped into appointing Prosser to a seat on the Wisconsin Supreme Court. Prosser didn’t get the appointment because he was the most qualified attorney or judge in Wisconsin, he got it because he had acted as a compliant lackey for the local political hacks.

For the past forty-three (43) years, Dave has had his significant snout firmly implanted in the public trough. Apparently no self-respecting law firm in the greater Milwaukee area was about to offer Dave a good paying job.

In February 2015, the Milwaukee Journal Sentinel reported that the Wisconsin Supreme Court Justice David Prosser went outside court proceedings by asking questions of a Wisconsin state laboratory.

The Sentinel’s report stated that the Supreme Court was advised in February that someone identifying himself as Justice Prosser contacted the state Laboratory of Hygiene on February 19 and asked questions that appeared to relate to a case pending before the Wisconsin Supreme Court.

Judges are prohibited from independently garnering information about a case. They are required to decide cases based on the facts submitted to them by the parties and/or their attorneys involved in said cases.

On February 27, 2015, Prosser magically withdrew from sitting on the case when his contact with the lab became public.

The chance Prosser will face disciplinary charges are slim to none. Even if he does, at worst he’ll receive a complimentary admonition.

As we speak (ca. April 2015), Prosser remains sitting as an Associate Justice on the Wisconsin Supreme Court.
