U.S. Judge Edward Chen of San Francisco; dimwitted buffoon

The state of Michigan presented Edward Chen with a law license in 1992 after he graduated from the University of California Berkeley School of Law.

Former President Obama was duped into appointing Eddie as a U.S. District Court Judge for the Northern District of California Judge in 2010. Eddie did not get the appointment because he was the most qualified attorney in the greater San Francisco area. He received it because he had proven to be a reliable lackey for the local political hacks.

In one matter, Eddie was assigned to preside over a case involving a lawsuit by various DOES against CVS Pharmacy and related entities claiming its prescription drug program, offered through employer-sponsored health plans, violates federal anti-discrimination provisions by denying access to critical benefits for enrollees afflicted with HIV or AIDS.

In his infinite ignorance and possible bigotry, Eddie dismissed the lawsuit with prejudice, meaning the plaintiffs would be forever barred from bring the claim in the future.

Subsequently, the plaintiffs filed an appeal with the Ninth U.S. Circuit Court of Appeals that led to Eddie’s dismissal of the case to overruled and reinstated. In ruling against Eddie’s asinine dismissal order, the Court of Appeals made the following findings.

• “Chen erred in finding that the plaintiffs were obliged to put forth allegations that the program impacted them in a unique or severe manner. That is not required under constituting case law.”
• “The plaintiffs need only plead that they were not provided meaningful access to the benefit.”
• “Construing the allegations in the light most favorable to Does, Does stated a claim for disability discrimination under the ACA.”
• “Applying the § 504 framework, does adequately alleged that they were denied meaningful access to their prescription drug benefit under their employer-sponsored health plans because the Program prevents them from receiving effective treatment for HIV/AIDS.”

Of course, Judge Chen doesn’t much give a damn about following the law and/or being reversed. He knows that no federal judge has ever been tossed off the bench for being a Certified Dumbo. Moreover, he isn’t concerned that the taxpayers will have to pay for his idiotic conduct since the matter will now have to be relitigated.
