Re:     Misconduct of Judge Algenon L. Marbley
            District Judge, Southern District of Ohio
            Violation of Limitations on Outside Income
 
Dear Circuit Executive:
 
Find enclosed herein a copy of a form complaint and a one-page explanation (Ex. 1) regarding the apparent misconduct of Judge Marbley relative to violating limitations on outside income for 2007-2008. I am not privy to the outside income declared by Judge Marbley for 2009-2010, however, if it was $36,000 then such income would also violate the limits imposed by statute.
 
Please provide me with a copy of Judge Marbley’s response to this complaint.

Pursuant to statute, outside income for federal judges is limited to 15% of base salary. The text box below establishes that Judge Marbley exceeded the 15% limit for the years 2007-2008.

I personally reviewed Judge Marbley’s annual Financial Disclosure Reports for 2007 and 2008 as posted at http://www.judicialwatch.org/judge/marbley-algenon-l.
 
It is patently clear that Judge Marbley’s outside income for teaching at Ohio State University School of Law as an instructor for the Spring and Fall Semesters exceeded the 15% limit imposed by statute.
 
Note:  On Nov 28, 2011, acknolwdgement of the complaint was received from the 6th Circuit Court of Appeals with a notice that a copy of the complaint had been provided to Cheif Judge Alice M. Batchelder.
