The Law Society of New Zealand presented Dianne Sara Lester with a law license in 1988.

 

The New Zealand Lawyers and Conveyancers Disciplinary Tribunal found Dianne guilty of the following misconduct.

  • Failed to timely file notice of $44,000 claim on client’s behalf
  • Failure to file timely claim led to client losing right to pursue it
  • Falsely advised client $114,000 settlement deed was in the process of being executed upon for collection
  • Failed to advise client time to file claim expired
  • Failed to inform client that defendant’s counterclaim active
  • Engaged in a pattern of misconduct
  • Failed to advise client of defendant’s settlement officer
  • Falsely advised client that unenforceable claim was awaiting a hearing
  • Failed to execute settlement deed for client recovery of $114,315
  • Failed to respond to client information requests
  • Failed to properly serve bankruptcy notice on client’s behalf
  • Misconduct involved multiple instances of misconduct
  • Engaged in reckless breach of Lawyers and Conveyancers Act
  • Breach fundamental fiduciary duties owed to clients

As a consequence of her misconduct, the enablers for Attorney Misfits sitting on the Disciplinary Tribunal punished Dianne by gifting her with a complimentary censure.
