Solicitor Brett Galloway of New South Wales; repeat offender

 

The Law Society presented Brett William Galloway with a law license in 1988.

 

The Office of the Legal Services Commissioner found Brett guilty of the following misconduct.

 

Brett’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to report trust irregularities
  • Breaches as to deficiencies in trust account
  • Caused unidentified transactions to be posted to trust ledger
  • Allowed for unauthorized payments from trust account to office account
  • Failed to implement a complaint trust account record
  • Failed to deposit transit money received in cash into trust account
  • Failed to lodge External Examiners Report within required period
  • Engaged in unsatisfactory professional conduct
  • Failed to report to Austrac significant cash transactions
  • Failed to properly supervise office staff
  • Failed to pay superannuation entitlements
  • Failed to pay annual leave entitlements

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Legal Service Commission punished Brett by gifting him with a complimentary reprimand and an $8,000 fine.

  • Commingled trust funds with personal funds
  • Caused a deficiency in his trust account
  • Failed to maintain trust records

As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Legal Service Commission punished Brett by gifting him with a complimentary reprimand.
