Attorney Robert Klock of Bentonville, AR; ethical misfit
The state of Arkansas presented Robert D. Klock with a law license in 1976 after he graduated from St. Mary’s University Law School.
The Committee on Professional Conduct found Robert Klock guilty of the following misconduct.
In one matter, Cesar Perez, an undocumented alien, hired Robert to represent him in removal proceedings initiation by the INS. Cesar understood that the fee arrangement was a flat fee but there was no written fee agreement. Receipts prove that Cesar paid Robert fees totaling $9,110.
Subsequently, Robert and Cesar appeared for a hearing on the cancellation of removal proceedings; however the court denied the request. Cesar then fired Robert and hired attorney Bogart.
Robert refused to provide copies of Cesar’s file to Mr. Bogart. Robert based his refusal by asserting that Cesar still owed him money.
Richard defended his action by claiming that Cesar’s claim before the INS was not winnable. However, Mr. Bogart’s appeal of the original denial was successful based on the same facts that were in Cesar’s file that Robert refused to turn over to Mr. Bogart.
As a consequence of his misconduct, enablers for Attorney Misfits sitting on the Professional Conduct Committee punished Robert by gifting him with a complimentary caution.
As we speak (ca. July 2013), Robert continues to practice in the Bentonville, Arkansas area.
