U.S. Judge Manuel Real of Los Angeles; moronic loser

It should be noted that Judge Real has been the subject of another piece in the past. That piece can be found by visiting the URL listed at the end of this article.

FYI: Judge Roy Bean was an infamous Justice of the Peace and saloon owner in Texas who called himself the "The Law West of the Pecos." Roy was also affectionately referred to as the Hanging Judge.

The state of California presented Manuel Lawrence Real with a law license in 1951 after he graduated from Loyola University Law School in Los Angeles.

President Lydon Johnson was duped into appointing Manuel to a seat on the U.S. District Court, Central District of California in 1966. Manuel didn’t get the appointment because he was the most qualified lawyer in the greater Los Angeles area. He got it because he had proven to be a reliable lackey for the local political hacks.

For the past fifty-two years (1964 to 2016) Manuel has had his significant snout firmly implanted in the public trough. Apparently, no respectable law firm in the Los Angeles area was about to offer Manuel a good paying job.

After ascending to the bench in 1966, it only took Manuel five years to prove that he was more than happy to abuse his power. At that time he got involved in a feud with defense attorney Victor Sherman over Sherman’s attempt to impeach the government’s only witness against his client James Hibler, who was accused of robbing a postal carrier. (Allison Frankel)

In the presence of the jury, Manuel taunted mocked Mr. Sherman about the Federal Rules of Procedure by saying:

“If you don’t know it Mr. Sherman, I am not here to teach you.”

The U.S. Circuit Court of Appeals for the Ninth Circuit reversed Mr. Hibler’s conviction. The court ruled that Manuel was “plainly wrong” to cut off Mr. Sherman’s cross examination. Of course Manuel didn’t much care about the expense incurred by the taxpayers that was caused by the reversal and retrial of Hibler. After all, he well knows that he can do as he sees fit and that he cannot be punished other than be impeached, which will never happen.

In another matter, the Circuit Court of Appeals was obligated to once again reverse a conviction wherein Manuel was the presiding judge. This case involved three defendant who allegedly schemed to defraud Medicare by supplying wheelchairs to patients who didn’t actually need them. The 9th Circuit again ruled that Manuel had tainted the trial with erroneous (incompetent) rulings that he delivered in an imperious (dictatorial) manner.

In its ruling, the Court of Appeals said in part:

  • “Considered collectively, a number of the court’s remarks devastated the defense, projected an appearance of hostility to the defense and went far beyond the court’s supervisory role.”
  • “Further, throughout trial, the district court [Manuel] made numerous erroneous rulings, which one-sidedly accrued to the benefit of the government.”

9th Circuit Court of Appeals records show that beginning in 2006, Manuel has been  reversed an astounding 87 times. He was reversed 12 times and upheld 20 times. This amounts to an incredible reversal rate of nearly 38 percent.

This is the kind of Moron (my sincerest apologies to Morons) you get when an appointment is totally political in nature. As of April 2016, Manuel is 92-years-old. Since he cannot be forced to retire from the bench, he could remain on the bench for another 10 or 12 years.

If in fact Judge Real chooses to remain on the bench until 2028, he would then tie former District Court judge Wesley Brown of Kansas who died on the bench when he was 104-years-old.

As one would suspect, Manuel was previously reprimanded for engaging in a variety of misconduct involving his handling of a bankruptcy case and a related California unlawful detainer action. The reprimand came shortly after the was called by the House Judiciary Committee to testify regarding said misconduct.

As we speak (ca. May 2016) Real continues to sit as a U.S. District Court Judge in Los Angeles, California.
