The state of
Wayne County Superior Court Judge Darren Dolehanty found Mike guilty of the following misconduct.
In one matter, Mike represented a couple in their lawsuit against Outback Steakhouse. At the trial a jury found in favor of Mike’s clients, ordering Outback to pay them $39 million. Trial testimony indicated the couple suffered severe injuries when their motorcycle was struck by a motorist who allegedly became intoxicated at the restaurant.
Subsequently, the Indiana Supreme Court overturned the verdict, in part because of Mike’s failure to notify Outback attorneys that a key witness would offer testimony that was substantially different than the account she had provide in an earlier deposition. Mike also made improper remarks during his closing argument in the Outback trial.
In another matter, Mike improperly hired ex-attorney Bruce McLaren who surrendered his law license after being indicted by a federal grand jury.
As one would suspect this wasn’t Mike’s First bite at the Attorney Misfit Apple Tree. He previously received two (2) complimentary reprimands and one (1) admonishment for engaging in a variety of misconduct.
As a practicing apologist for Attorney Misfits, Wayne County Superior Court Judge Darren Dolehanty recommended that the Indiana Supreme Court merely censure Mike despite the fact that he’s been previously disciplined three (3) times.
