Judge Janice Clark of Baton Rouge; serial offender

 

The state of Louisiana presented Janice with a law license in 1977 after he graduated from Indiana University Law School.

 

The Louisiana Judiciary Commission charged Janice with the following misconduct.

 

Janice’s most recent misconduct involves a defamation lawsuit Marie Reed filed against the East Baton Rough Parish Sheriff’s Office in 2010.

 

Janice improperly dismissed the lawsuit in April 2011 despite the fact that neither party had a motion pending before the court for dismissal, and after a hearing in which Janice questioned Ms. Reed about two motions without her attorney being present.

 

The commission said Janice’s conduct “constituted an egregious legal error that rose to the level of judicial misconduct” and showed “a lack of professional competence in the law.” In other words, the commission said Janice was a Dumbo.

 

During the commission’s investigation, Janice gave multiple confliction reasons for her actions, which the commission found “troubling” and indicative of a “lack of candor.” Put simply, they said she was  a liar.

 

As one would suspect, this wasn’t Janice’s First bite at the Judicial Misfit Apple Tree as set forth below.

  1. In 2003 charged improperly making public endorsements of a redistricting plan, making a loan to herself and failed to remove herself from a case – received a complimentary private reprimand.
  2. In 2002 received complimentary letter of caution for jailing a party for contempt without following lawful procedures involving due process.
  3. In 2001 received another complimentary letter of caution for failing to disclose that a lawyer appearing in a case before her was representing her in a personal legal matter and for failing to refer a recusal motion as required by the rules to another judge.

All that’s left now is to see what if any punishment the enablers for Judicial Misfits sitting on the Louisiana Supreme Court mete out to Janice for her fourth bite at the Judicial Misfit Apple Tree.

 

Since this is only the fourth time she’s been brought up on misconduct charges, maybe the Supreme Court Justices will punish Janice by giving her a 30-day, all paid vacation to the Aruba. That’ll teach the serial miscreant, right?

 

As we speak (ca. April 2014), Janice remains on the bench in Baton Rouge.
