Judge Edward Cottingham Sr. of The state of During his tenure as a Circuit Court judge, Eddy presided over the case of convicted sex offender Kenneth Glenn Hinson, who he previously ordered released from prison despite pleas from prosecutors that he be committed indefinitely. After his release, Hinson was charged with kidnapping and raping two teenage girls in an underground room behind his home. The girls were sexually and left bound inside the room, concealed under a shed, but managed to free themselves and get to safety. The dungeon they were held in was a chilly, crypt-like space, just 4-1/2 feet deep and roughly the length and width of a midsize car, with the floor and walls lined with two-by-fours and illuminated with a single 75-watt bulb. Hinson was convicted in 1991 of second-degree criminal sexual conduct for the rape of a 12-year-old girl and served just over 9 years in prison. Just prior to his release from prison, two review committees recommended that he be committed indefinitely to a Department of Mental Health facility for treatment. Eddy responded to prosecution pleas for indefinite commitment by claiming that probable cause didn’t exist that Hinson would reoffend or that he suffered from any mental incapacity. Obviously, Eddy’s conclusion was seriously flawed. In fact, had he not sided with a convicted predator, the two 12-year-old girls likely would not have been raped by Hinson. As we speak (ca. March 2014), Eddy continues to sit as a visiting senior judge compliments of the resident comedian of the South Carolina Supreme Court, Chief Justice Jean Toal.
