Judge Mary Ann Ottinger of Seattle; moron; Il Duce Wannabee,  ethically inept

 

Unfortunately, Judge Mary Ann Ottinger was appointed to the bench in King County Washington (Seattle) in 1992.

 
During her disservice to the citizens of the Seattle area, Judge Mary Ann Ottinger was disciplined twice by the Judicial Commission for engaging in an assortment of misconduct, which is set forth below.
 
1st bite at the Judicial Misfit tree (ca. 04/04/04)
 
The Judicial Commission found Judge Mary Ann Ottinger guilty of the following misconduct:
  • Engaging in a pattern of conduct wherein she violated the constitutional “due process” rights of defendants appearing before her.
  • Repeatedly failed to accept guilty pleas from pro se defendants.
  • Failed to advise defendants of the elements to the crimes they were pleading guilty too.
  • Failed to advise non-citizens that a plea of guilty is grounds for deportation, exclusion from the US, or denial of citizenship. (Unfortunately, such conduct is not grounds for removal from the bench)
  • Failed to inform parties in probation revocation hearings of their constitutional right to counsel.
Prior Warnings of Misconduct
 
In 2002, the Commission told Judge Mary Ann Ottinger of its concerns about her conduct as described above. Mary responded by saying she would correct her conduct (abide by the oath she took to uphold the U.S. and Washington State Constitutions). Isn’t that just special? I’ll be a good girl, I promise.
 
Surprise, surprise! Mary lied to the commission because she continued to violate the constitutional rights of persons unfortunate enough to appear before her. But to be fair to Mary, she did have her fingers crossed when she lied. That means it doesn’t count, right Mary?
 
Unauthorized Practice of Law
 
While on the bench, Judge Mary Ann Ottinger improperly provided legal assistance to the City of Issaquah and other municipalities in their dispute with King County regarding the reorganization and utilization of resources (aka, money) for her court. In judicial jargon this is called: “Pimping for the Court.” 
 
In addition to providing research and legal advice, Mary secretly “ghost wrote” correspondence for the City of Issaquah to be submitted to King County without giving notice she was the author. She also advised the City of Issaquah to sue King County.
 
Mary’s Novel Defense
 
Judge Mary Ann Ottinger’s defense to unlawfully practicing law while on the bench was that, she owed it to the voters of Issaquah who voted for her (been duped) and not to the King County citizens who paid her wages. I see Mary; you were “obligated” to violate your oath of office and the Code of Judicial Conduct, right. Cool!
 
Mary’s Answer to Misconduct Complaint
 
Judge Mary Ann Ottinger had the chutzpah to argue that her constitutional “due process rights” under the 14th Amendment were violated by the process in which she was investigated and the manner in which the hearing was held by the commission. I see Mary. You’ve got constitutional rights, however, those “lesser beings” appearing before you don’t deserve them, right?   What a loser and hypocrite!
 
Commission Punishment
In addition to promising to be a good little girl, Mary also agreed with the commission’s demand that she participate in training related to the proper administration of her court, including the constitutional treatment of persons appearing before her. 
 
Towards that end, Mary agreed to be punished by taking a trip to the Judicial College in Reno, Nevada or some other venue offering such courses like Vail, Colorado (only offered in the winter), Monterey Bay, California (summer terms only), or Palm Beach, Florida (winter terms only). Hot damn brothers and sisters, these are some really punitive folks, don’t ya think?
 
The Commission then presented Mary with a complimentary reprimand.
 
2nd bite at the Judicial Misfit tree (ca. 05/05/06)

 
As expected and given the fact that Judge Mary Ann Ottinger is a certified moron and Il Duce Wannabee, she was charged with same offenses as set forth above by the Judicial Commission in 2005.
 
As a result of this repeat performance, the Commission presented Judge Mary Ann Ottinger with a complimentary censure and thirty-day suspension without pay.
 
Judicial Commission dissenting opinion
 
Commission member Antonio P. Cube, Sr. filed a scathing dissent wherein he opined that Judge Mary Ann Ottinger should be removed from office. Kudos to Mr. Cube and shame on the nine certified enablers and apologists that determined that Judge Mary Ann Ottinger deserved to remain on the bench.
