Attorney Davis Loftin of West Memphis, AR; ethical goblin

 
The state of Arkansas presented Davis Henry Loftin with a law license in 1979 after he graduated from the University of Memphis Law School.
 
The Committee on Professional Conduct found Davis guilty of the following misconduct.
  1. Failed to obey court order
  2. Failed to provide competent representation (Dumbo)
  3. Failed to act with due diligence (slacker)
  4. Failed to respond to clients request for information
  5. Engaged in conduct prejudicial to the administration of justice
In one matter, Jonathan and Sara Demuth hired Davis to represent them in a Chapter 13 bankruptcy filing. Davis filed the bankruptcy petition in March 2008. In July 2012, Davis filed a Notice of Change of Address for his clients. Two months later, Davis filed a Modified Plan and Amended Schedules for his clients; however, the bankruptcy trustee filed an objection to the Modified Plan.
 
A hearing on the Modified Plan was cancelled when Davis agreed with the trustee to file a modification of the plaint within twenty-one (21) days. The court order required Davis to file the modification no later than October 2, 2012.
 
Davis failed to file the Modification on behalf of his clients as the court ordered. As a result of Davis’ gross misfeasance, the Trustee field a Motion to Dismiss on October 26, 2012. The court then scheduled a hearing on the Motion to Dismiss for December 6, 2012.
 
When Mr. Demuth received notice of the hearing and Motion to Dismiss, he fired Davis. Mr. and Mrs. Demuth then hired another attorney to ensure that their interests were adequately and professionally protected.
 
As a consequence of his misconduct, enablers for Attorney Misfits sitting on the Professional Conduct Committee punished Davis by gifting him with a complimentary reprimand.
 
As we speak (ca. July 2013), Davis practices at 310 Mid-Continent Plaza in West Memphis, Arkansas.
