Attorney William A. Carter of Albany; Il Duce Wannabee, moron, ethical dwarf

 

From 2002 through 2005, attorney William A. Carter sat as a judge on the Albany City Court.
 
During this short three-year tenure, Judge William A. Carter was found guilty by the New Judicial Commission of the following judicial misconduct:
 
Judge William Carter threatens party with physical harm
 
In Oct. 2004, Talib Alsaifullah was brought before Judge William Carter Bill for arraignment on a loitering charge. At the time Talib was also facing an assault charge.
 
In November, Judge William Carter ordered Talib to appear before him about a letter expressing concerns about the assault charges and the representation provided to Talib by the public defender.
 
At the hearing, Judge William Carter allowed Talib to argue his position. After Talib became agitated and said he didn’t want to participate because he claimed it was illegal, Judge William Carter became angry and, without adjourning the hearing, abruptly removed his glasses and robe, got up from the bench, and proceeded rapidly towards Talib, in a manner indicating his purpose was to confront him. One witness in the courtroom heard Bill say to Talib, “You want a piece of me?”
 
As Judge William Carter left the bench, a policeman quickly removed Talib from the courtroom while another policeman physically blocked Bill’s path by placing himself in front of Talib. Judge William Carter tried to go around the officer by stepping to one side and then the other, but the officer continued to block him by sidestepping along with him each time.

In March 2005, a Mr. Willis came before Judge William Carter to be arraigned on several criminal charges.
 
After the arraignment concluded, the arresting officer told Judge William Carter that Willis had flipped him off in the courtroom, Bill said he wouldn’t do anything because he didn’t witness the act. When the officer expressed dissatisfaction, Judge William Carter said, “If you are so upset about it, why don’t you just thump the shit out of him outside the courthouse, because I’m not going to do anything about it.”
 
At the time of this incident, Judge William Carter was fully aware that he was under investigation for his misconduct involving Talib.

Punishment meted out to Judge William Carter
 
The enablers and apologists for judicial misconduct in New York sitting on the Judicial Commission punished Judge William Carter by providing him with a “complimentary censure.”
 
In February 2004, these same enablers and apologists gifted Judge William Carter with a “complimentary ‘secret’ caution” for his repeated conduct in violating the due process rights of defendants appearing in his so-called court.
 
New York State Bar conceals attorney William Carter’s prior discipline
 
When searching attorney information on the New York State Bar Web site, these certified enablers and apologists for dishonest attorneys, do not mention the fact that attorney William Carter was disciplined on two occasions while he was a judge in Albany City Court.
 
I guess the New York State Bar is more concerned with assuring that attorneys like William Carter are able to earn a dishonest living than they are in protecting prospective consumers of legal services in the Albany area.
