Attorney James Archibald of Idaho Falls; ethical leprechaun
While sitting as a Magistrate Judge in Idaho Falls, James was accused of being drunk in public and groping two women at a juvenile drug court conference in Florida.
Judge Archibald continued to sit on the bench for an additional six months after the charges were lodged against him, but resigned two weeks before his probationary period ended. Archibald had the chutzpah to claim he resigned due to depression and the pressure of being a Magistrate Judge. Clearly, James missed his calling as a standup comedian.
Just prior to his resignation, a woman went public with the charges against Archibald. The woman, an Idaho attorney, did not file criminal charges; instead she took her case to the Idaho Judicial Council who heard the case in private. Judge Archibald did not dispute the charges made against him.
Idaho Supreme Court Chief Justice Linda Copple Trout had the audacity to say that the system worked in Archibald’s case. “If that’s done through resignation, the council has carried out its responsibility to ensure a strong judiciary,” Trout said. The Chief Justice also missed her calling as a standup comedian!
In Idaho, if a judge merely resigns the details surrounding the situation remains secret. If the judge is fired or the council recommends discipline, the charges against the judge become public. Isn’t that special?
Because Judicial Misfits in Idaho are held to a much lower standard of conduct then everyone else, James never faced any discipline in regards to his law license.
