Attorney Edward Daniels of Albany, OR; ethical dwarf

The state of Oregon provided Edward L. Daniels with a law license in 1973.

The Oregon State Bar found Edward guilty of the following misconduct
  1. Engaged in an egregious conflict of interest
  2. Failed to obtain written consent from client to engage in business transaction
  3. Deviated from standard care that reasonably attorney would have exercised
In one matter, Alton Sullivan hired Edward to represent him on a variety of issues for many years before he and Edward decided to form an LLC to purchase a large piece of land together for the purpose of raising and harvesting Christmas trees.

Edward prepared the paperwork creating the LLC, and acted as its attorney during the partnership. Later one, the partnership bought a 450-acre piece of land and timber. Sullivan paid his share for the property in cash, while Edward financed part of his share via a contract with the seller. The purchase contract was in both of their names, although the amount owing was entirely Edward’s responsibility.

The partnership then bought two more parcels of land with Sullivan paying his in cash and Edward financing his entire share via a contract with the seller. The seller agreed to take Edward’s note only if Sullivan agreed to sign a personal guarantee, which he did.

Edward also prepared the Timber Sale contract where he and Sullivan both became liable to make monthly payments on $275,000 owed to the seller, even though Edward was the only one that owed money to the seller.

How nice it was of Edward to have his client personally responsible for Eddy’s financial liabilities. Kind of gives a new meaning to “screwing a longtime client.”

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Oregon Supreme Court punished Edward by gifting him with a complimentary reprimand.

As we speak (ca. June 2013) Edward practices with the Law Office of Daniels and Ivers at 220 SW 6th Avenue in Albany, Oregon

On the Law Office of Daniels’ website at www.danielsivers.com, it makes absolutely no mention of the misconduct of Edward as aforementioned. The firm apparently chose to not disclose said information for fear that it might limit its future victim pool.
