A three judge panel of Fairfax County Circuit Court found Mark John Sullivan guilty of the following misconduct.
At the time of his misconduct, Mark was employed as an assistant State’s Attorney. Mark was assigned to prosecute Devin Manigo, Antonio Wilson Richey Price for their crimes related to the robbery of a Prime Mart convenience store.
Subsequently, Wilson and Price agreed to testify against Manigo. In return for their cooperation, Mark entered into an agreement with them that he would personally appear at their court hearings to advise the sentencing judge that they had cooperated with the Manigo prosecution.
At Manigo’s trial, both Wilson and Price gave perjured testimony when they denied they were receiving any consideration from the state for testifying against Manigo. Of course Mark knew for a fact that their testimony was patently false; however, in his zeal to get Manigo he was willing to suborn their false testimony.
Subsequently, defense counsel discovered the false testimony of Price and Wilson and filed a Motion to set Aside the Verdict. After the trial court held a hearing on the matter, it granted the motion, ruling that Mark had failed to correct the false testimony of Price and Wilson and that such a failure constituted Manigo’s due process rights.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the three-judge panel, punished Mark by gifting him with a complimentary admonishment.
As we speak (ca. March 2013), Mark continues to practice in the Fairfax, Virginia area.
