Attorney Jared Bramwell of Draper, UT; ethical dwarf
The state of Utah presented Jared L. Bramwell with a law license in 2002 after he graduated from the University of Oregon Law School.
The Ethics and Discipline Committee of the Utah Supreme Court found Charles guilty of the following misconduct.
In one matter, Jared was hired to represent a client in pending civil matters. In one of the cases, opposing counsel filed a Motion for Prejudgment write of Attachment along with a supporting memorandum, which led Jared to file a memorandum in opposition.
After hearing arguments on the motion, Judge Robert P. Faust granted the motion and stated in his order, “The prejudgment write of attachment is NOT against their house. The house can be sold, but the proceeds must be held in an account in Utah and cannot be distributed.” Opposing counsel then provided a copy of Judge Faust’s order to Jared.
A Trust Deed between Jared and his client was recorded in Salt Lake Count. The stated purpose of the Trust Deed was to: (a) secure payment of attorney’s fees, costs and interest in the principal sum of $500,000.00; and (b) to secure indebtedness evidenced by an attorney retainer agreement between Mr. Bramwell and the client.
Jared did not send notice to opposing counsel or to the Court that the Trust Deed had been recorded. Partly due to Jared’s conduct with respect to the Trust Deed, Judge Faust held a two-day contempt hearing regarding Jared’s conduct; however, he declined to hold him in contempt.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court punished Jared by gifting him with a complimentary reprimand.
