Attorney Richard Manelis of Framingham, MA; ethical dwarf
The Massachusetts Supreme Court presented Richard E. Manelis with a law license in 1968.
The Board of Bar Overseers found Richard guilty of the following misconduct.
In one matter, a client hired Richard to draft a will for his father. Richard had never previously represented the son or the father.
The son advised Richard what the provisions of the will should be. Richard then prepared the will according to the son’s directions and provided a copy to the son to review with his father. At the son’s direction, Richard went to the son’s home for the execution of the will by the father. The son and two witnesses were present when Richard first met the father and the will was signed at that time.
Richard did not meet separately with the father to discuss the will prior to its execution. This new will revoked a prior will and left the father’s entire estate to the son. The prior will divided the father’s estate equally between the son and his brother.
Even though Richard had a duty to discuss the new will with the father to alert him to the fact that it now excluded the brother to the benefit of his client, he failed to so act. Apparently, Richard lacks the intellectualism to understand what the term “conflict of interest” means.
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Richard by gifting him with a complimentary reprimand.
As we speak (February 2013) Richard practices with Manelis & Beresen at 929 Worcester Road in Framingham, Massachusetts.
