Ex-Judge Daniel Bauer of Fernley, NV; Judge Roy Bean Wannabee

 
FYI: Judge Roy Bean was a saloon-keeper and Justice of the Peace in Val Verde County, Texas, who called himself “The Law West of the Pecos.” Judge Bean was also affectionately referred to as the “Hanging Judge.”
 
Prior to February 2012, Judge Bauer was a Municipal Court Judge in Fernley, Nevada, which is about 35 miles east of Reno.
 
In late 2011, Judge Bauer was criminally charged by the Lyon County District Attorney with the wrongful exercise of official power and oppression under color of office. In early 2012, Judge Bauer resigned his judicial office and as a result the DA dismissed the criminal charges pending against him.
 
On December 31, 2012, the Nevada Commission on Judicial Discipline found Judge Daniel Bauer guilty of the following misconduct, which was primarily based on the criminal charges previously filed against him.
  1. Failed to act in a manner that promotes confidence in the integrity of the judiciary
  2. Abused the prestige of his judicial office to advance his personal interests
  3. Engaged in improper extrajudicial activity that undermined the judge’s credibility
  4. Engaged in extrajudicial activity that was coercive
  5. Failed to comply with Nevada law
In September 2011, Judge Bauer decided to play judge, jury and prosecutor when he conducted a traffic stop of Randi Riede in Fernley, Nevada. While playing his role as Judge Roy Bean, Judge Bauer acted as follows:
  1. Utilized a retiree badge issued to him due to his status as a retired Nevada Highway Patrol officer
  2. Falsely stated to Randi that he was a police officer
  3. Ordered Randi to follow him to a convenience store and then detained her
  4. Identified himself as a Judicial Officer
  5. Falsely told Randi that she wouldn’t be able to successfully contest the traffic ticket due to his status as a Judicial Officer
  6. Told Randi that he would personally arrest her if he saw her again
On February 1, 2013, Bauer filed his formal answer to the charges filed against him by the Nevada Commission on Judicial Discipline through his attorney Tammy Riggs of Reno, Nevada. The so-called answer was a generic denial of the charges against him, which in and of itself doesn’t pass the involuntary laugh test.
 
Within the next several months we should know what punishment the Commission will mete out to Judge Bauer for his acting role as Judge Roy Bean.
