Attorney Jerry Wark of Phoenix; lying Dumbo

 
The state of Arizona presented Jerry W. Wark with a law license in 1979 after he graduated from the University of Tulsa Law School. Jerry is also licensed to practice in Oklahoma and Vermont.
 
The Arizona State Bar found Jerry guilty of engaging in the following misconduct.
  1. Failed to consult with client to afford client to make informed decisions re: representation
  2. Failed to act with due diligence (slacker)
  3. Failed to communicate with clients
  4. Asserted claim or defense he knew or should have known was inaccurate
  5. Engaged in conduct prejudicial to the administration of justice
  6. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  7. Failed to provide competent representation (Dumbo)
  8. Failed to promptly respond to ethics complaint (Up Yours, said Jerry!)
Jerry was hired to represent a client in a personal injury matter. Jerry failed to attempt to settle the client’s case and failed to file a lawsuit on the client’s behalf before the statute of limitations had expired. Jerry then failed to notify his client of his inaction and failed to tell her that she could no longer pursue her personal injury claim due to his gross negligence and incompetence.
 
To make matters worse, Jerry then lied to his client by making her believe that her personal injury claim was still pending. He went further by lying to her that he was awaiting receipt of her medical bills before he could settle his case. These blatant lies took place after Jerry the Moron allowed the statute of limitations to expire.
 
As a consequence of his misconduct, the Patron Saints of Attorney Misfits sitting on the Arizona Supreme Court punished Jerry by gifting him with a complimentary censure.
 
As we speak (ca. February 2013) Jerry practices at 301 East Bethany Home Road in Phoenix, Arizona.
