Attorney David Shriver of Topeka; ethical gremlin

The state of Kansas presented David G. Shriver with a law license in 1975.

The Kansas Disciplinary Board found David guilty of the following misconduct.
  1. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  2. Failed to be candid (truthful) towards tribunal
  3. Failed to act with due diligence (slacker)
  4. Caused actual injury to the victims (his sisters)
  5. Misconduct motivated by selfishness
  6. Misconduct involved multiple offenses
In one matter, David was named as trustee for his mother and also possessed a power of attorney to act on her behalf as to her financial affairs. Over the years, David borrowed money from his mother to operate his unsuccessful law office. Rather than sign a note for the loans, his mother merely asked that he consider the loans when she died in fairly distributing her assets among his two sisters. David promised his mother he would do so upon her death. Two of the loans represented Certificates of Deposits that Dave cashed in for $36,000.

When his mother died, David was named as executor of her will by the probate court. When he finally filed the necessary papers regarding his mother’s assets, David lied to the court by not disclosing the $36,000 he had borrowed from his mother.

Subsequently, Dave’s sisters hired an attorney who informed the probate judge of the loans to Dave that he did not disclose to the court. The court later ordered that Davie pay $4,650 to his sister Kay Kwon, $15,000 to his sister Linda Shriver, and $5,000 to attorney Martin.

As a consequence of her misconduct, the Cheerleaders for Attorney Misfits sitting on the Kansas Supreme Court punished David by gifting him with a complimentary censure.

As we speak (ca. February 2013) David is employed by the Kansas Association of School Boards at 1420 Southwest Arrowhead Drive in Topeka, Kansas.
