Attorney Leroy Falgout of Kenner, LA; ethical elf

 
The state of Louisiana presented Leroy J. Falgout with a law license in 1987 after he graduated from Missippi College of Law.
 
The Office of Disciplinary Counsel found Leroy guilty of the following misconduct.
  1. Failed to fully disclose settlement terms with client
  2. Failed to provide written fee agreement to client as required by the rules
  3. Failed to cooperate with disciplinary investigators (Up Yours, said Leroy!)
  4. Failed to properly supervise office staff
In one matter, Leroy was hired by Richard Longworth and his wife regarding a claim against their automobile insurer, Old Hickory. Longworth’s car was stolen and Old Hickory declined coverage due to a coverage dispute. Leroy and the Longworth’s never executed a written fee agreement, however, they orally agreed to a one-third contingency fee.
 
The case was settled after a pretrial was held. The settlement called for Old Hickory to pay a total of $8,045. One check for $5,132.60 went to the lien holder.  The second check reflected that the remaining $2,912.40 was allocated as $1,892.40 for property damage, $800.00 for attorneys' fees, and $220 for court costs.
 
Old Hickory's attorney requested that the $2,912.40 check be his endorsement would be difficult to obtain.  Despite the request, however, the check was simply made payable to Falgout, individually, and not as attorney for the Longworths.
 
Sharon was at the courthouse at the time of the settlement with Old Hickory’s attorney. She testified at the disciplinary hearing that Leroy did not inform her of the $2,912.40 payment at the time of the settlement. She later learned of the second payment from Old Hickory’s attorney.
 
As a consequence of his misconduct, the Louisiana Supreme Court punished Leroy by gifting him with a complimentary reprimand.
 
As we speak (ca) January 2013) Leroy practices at 55 25 Janice Avenue in Kenner, Louisiana.
