Attorney H. Paul Carroll of Newburyport, MA; moronic loser
 
The Massachusetts Supreme Court presented H. Paul Carroll with a law license in 1999.
 
The Board of Bar Overseers found H. Paul guilty of the following misconduct.
 
In one matter, H. Paul represented a client in a medical malpractice matter on a contingent fee basis. H. Paul never prepared a written fee agreement for the client to sign as required by the rules.
 
Subsequently, H. Paul filed a lawsuit in Suffolk Superior Court for his client against Beth Israel Deaconess Medical Center, Inc., and two physicians. The lawsuit alleged that after treating his client for four years, the defendants failed to diagnose his Cystic Fibrosis and pulmonary infraction which resulted in permanent damage to his lungs.
 
H. Paul failed to serve a copy of the lawsuit on the defendants within 90-days as required by Massachusetts Court Rules. He then filed an emergency motion for extra time to serve the lawsuit, which the court granted. In his motion he falsely claimed that he had filed a “skeleton” complaint so as to preserve his client’s claims and had retained one expert and identified another to “explain the complicated medical issues” so he could “draft a more complete Amended Complaint.”
 
H. Paul again failed to serve the complaint on the defendants. H. Paul then filed a second emergency motion for extra time that contained the same false claims he inserted in his first motion, along with claiming he had been violently assaulted and unable to work for two weeks. The trial court granted the second motion for extra time.
 
Rather than comply with the 2nd extension of time to serve the complaint, H. Paul filed a third emergency motion for extra time. In his third motion, H. Paul asserted that he had recently contacted Beth Israel’s legal liaison, who represented to him that he would likely be able to accept service for all the defendants, but that he was unable to perfect service because Beth Israel’s office of Risk Management was closed. H. Paul also restated the same false claims contained in his first and second motions for extra time.
 
Over the next three months, H. Paul filed his 4th, 5th and 6th motions for extra time to serve the complaint, all of which were granted by the trial court. After his 6th motion was granted, H. Paul did not have the complaints served on the defendants as ordered by the court. As a result of H. Paul’s egregious negligence and incompetence, the trial court dismissed his client’s medical malpractice lawsuit.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished H. Paul by gifting him with a complimentary reprimand.
 
As we speak (ca. December 2012) H. Paul practices with The Carroll Law Firm at 79 State Street in Newburyport, Massachusetts.
