Attorney Rubina Wadhwa of Lansdowne, VA; lying loser

The state of Pennsylvania presented Rubina Arora Wadhwa with a law license in 1989. 

 
The Office of Disciplinary Counsel (ODC) found Rubina guilty of the following misconduct.
  1. Failed to provide competent legal representation (moron)
  2. Failed to act with reasonable diligence (slacker)
  3. Failed to keep client informed of status of legal matter
  4. Failed to comply with client requests for information
  5. Made a false statement of material fact to a trial court
  6. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  7. Failed to notify client of hearing date
Rubina’s discipline was based on an Order of the Assistant Chief Immigration Judge of the U.S. Justice Department wherein she was suspended from practicing before the INS and the Executive Office of Immigration Review.
 
The basis for Rubina’s suspension was her submitted of fraudulent medical records in support of an application for a travel document in connection with an immigration case.
 
Rubina appeared in Arlington, Virginia on behalf of her client, Atif Sultan, for Special Registration, which was a program initiated by the Dept. of Justice to identify and interview males from certain Muslin countries who were admitted to the U.S. on a non-immigrant visa.
 
Prior to appearing in Arlington, Mr. Sultan was required to appear for Special Registration because he had already filed an application for adjustment of status to permanent residence. When he appeared for Special Registration, Mr. Sultan was arrested and charged with being removable and would have to appear before the Immigration Court because he had overstayed his initial visa. At this time, Rubina offered to represent Mr. Sultan and get him released from prison.
 
Mr. Sultan then hired Rubina to represent him in the removal proceedings in Arlington. A hearing was later scheduled by the Immigration Court. Sultan then spoke with Rubina and she told him his immigration hearing was schedule for December 23. However, the actual hearing date was December 1. Neither Mr. Sultan nor Rubina appeared for the December 1 hearing, which resulted in the Immigration Judge ordered that Mr. Sultan be removed and deported to Pakistan as a result of failure to appear.
 
On December 14, Mr. Sultan spoke with Rubina about the deportation order. Rubina told him she didn’t appear for the hearing because she was sick. She then told him she would file a Motion to Reopen. In her Motion to Reopen, Rubina falsely claimed she missed the hearing because she “was hospitalized at the time of the hearing.” The Immigration Judge subsequently discovered that Rubina lied to him about being hospitalized.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Pennsylvania Supreme Court punished Rubina by gifting her with a complimentary 9-month suspension of her law license.
