Attorney Paul Giba of Philadelphia; thief

 

The state of Pennsylvania presented Paul Robert Giba with a law license in 1982. 
 
The Office of Disciplinary Counsel (ODC) found Paul guilty of the following misconduct.
  1. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  2. Misappropriated (stole) client funds
  3. Commingled client funds with personal funds
Paul entered into an informal arrangement with attorney Jonathan E. Turak of West Virginia, whereby Turak would refer cases to Paul that had to be prosecuted in Pennsylvania or the U.S. District Court for the Western District of Pennsylvania. Over several years, Turak referred four clients (1) Christopher Stilwell, (2) Norman and Terra Crook, (3) Teresa Smith, and (4) Jerry Shelton. IN regard to the Cooks, it was agreed between Turak and Paul that Paul should receive 60% of the contingent fee, and Turak 40%.
 
Over a three year period of time, Paul was at various times entrusted with funds in 15 different client matters including those that referred by Turak, and for eleven other clients.
 
Paul misappropriated (stole) funds in his trust account for his own purposes over a three year period of time. On numerous occasions his trust account had a shortage of over $100,000, and the highest amount was $176,660. Most of the misappropriations (thefts) involved funds marked for reimbursement of subrogation and healthcare claims, but some involved payments due to Paul’s clients.
 
Paul’s Hyperbolic (BS) Defenses
 
Paul had the audacity to blame his multiple thefts of client funds on the following:
  • Minor daughter suffered from eye deficiencies and cardiac problems
  • Step-daughter exhibited disciplinary problems
  • Wife engaged in an extra-marital affair, which severely strained their relationship
  • Paul developed major depression that led to inability to function at work
  • Paul’s claimed depression included symptoms of repressed anger, despair, feelings of hopelessness and helplessness, loss of interest in activities, lack of energy, sleep and appetite problems
As one would suspect, the comedians sitting on the Pennsylvania Supreme Court found that his misconduct was caused by the aforementioned claims. Do you think these same buffoons would make the same finding if it was put forward by a convicted rapist?
 
Because Attorney Misfits in Pennsylvania are held to a much lower standard of conduct then everyone else, Paul was never criminally charged for misappropriating (stealing) client funds.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Pennsylvania Supreme Court punished Paul by gifting him with a complimentary 2-year suspension of his law license.
 
As we speak (ca. November 2012) Paul practices at 1840 Mayview Road in Bridgeville, Pennsylvania.
