Judge Dennis Cummings of Bethel, Alaska; moron, ethical gnome

In March 2008, Judge Dennis Cummings was presiding over a criminal trial in the District Court in Bethel, Alaska.

During the trial Judge Dennis Cummings illegally passed a note to the prosecutor in an obvious attempt to assist him in gaining a conviction. Of course Judge Dennis Cummings never provided a copy to the defense counsel

Subsequently, an ethics complaint was filed against Judge Dennis Cummings with the Alaska Commission on Judicial Conduct in regards to Judge Dennis Cummings’ illegal conduct.

After an investigation of the matter, the Judicial Commission recommended to the Alaska Supreme Court that Judge Dennis Cummings be suspended from the bench. The Commission ruled that Judge Dennis Cummings had engaged in illegal ex parte (one-sided communications) and was less than truthful (lied) about the matter in various official proceedings.

In July 2009, the enablers and apologists sitting on the Alaska Supreme Court ruled that Judge Dennis Cummings would be suspended from the bench for three months beginning on July 27, 2009.

The Court opined that agree in passing a note to the prosecutor during a criminal trial, Judge Dennis Cummings was attempting to assist the prosecutor in obtaining a conviction. However, the prosecutor couldn’t make heads or tails out of the illegal note that Judge Dennis Cummings passed him so he never used the information during the trial.

Unbelievably, the morons on the Supreme Court ruled that since the prosecutor wasn’t able to utilize the illegal note during the trial and use it to convict the defendant, that this in and of itself was a mitigating factor. Now, let me tell you what folks, this is the asinine argument I’ve heard in a long time.

What these morons are really saying is that if you robbed a bank, but the cash fell onto the bank floor while you were fleeing that they would consider this to be a mitigating factor in your favor while deciding the degree of your punishment.

And the Supreme Court stated that this wasn’t the first time that Judge Dennis Cummings illegally engaged in ex parte communications. He previously did so by passing a note to a witness during a trial.

The final blow as to punishment for Judge Dennis Cummings came when the morons on the Supreme Court required that before he returned to the bench (ca. October 27, 2009) that he do the following:

Acquire additional judicial training at his own expense
Training to cover the Code of Judicial Conduct and in particularly cover topics of illegal ex parte communications, judicial impartiality, and the appearance of impropriety

What an unmitigated joke! What in the hell was this moron doing on the bench in the first place? If Judge Dennis Cummings was so incompetent (he clearly is) that he was ignorant that it was unethical to do what he did, then he has forever forfeited any right to sit in judgment of the good folks in Bethel, Alaska.
