Attorney Anthony Austria of Newburgh, NY; Judge Roy Bean Wannabe

FYI: Judge Roy Bean was a saloon-keeper and Justice of the Peace in Val Verde County, Texas, who called himself “The Law West of the Pecos.” He was also affectionately referred to as “The Hanging Judge.”

The state of New York presented Anthony Gregory Austria with a law license in 1971 after he graduated from Emory University Law School.

At one time, Anthony sat as a Judge of the City Court of Newburgh in Orange County, New York.

During his tenure on the bench, the New York Commission on Judicial Conduct found Anthony guilty of the following misconduct.

Anthony found it acceptable to repeatedly trample on the constitutional due process of litigants (victims) who appeared in his so-called court by engaging in the following misconduct:
  1. Failed to advise defendants of their right to communicate with counsel free of charge
  2. Failed to allow defendants to exercise their right to counsel
  3. Refused to allow defendants an adjournment of the proceedings so they could employ counsel
  4. Refused to allow indigent defendants the right to obtain counsel
  5. Set punitive bails having nothing to do with assuring that defendants would appear in court
  6. Engaged in prohibited discussions with defendants aimed at eliciting incriminating statements from them
  7. Made statements in open court indicating his opinion of a defendant’s guilt
Comedic orders of Judicial Commission to Judge Austria

The comedians sitting on the Judicial Commission had the chutzpah to proclaim that Anthony had agreed to the following:

“To enroll in and complete the next available basic training program, and, thereafter, the next available advanced training program offered by the Office of Court Administration for part-time judges.”

It is laughable to the nth degree for anyone to suggest that Anthony required basic training in determining what the term “due process” means. What a total waste of taxpayer resources!

As a consequence of his misconduct, the cheerleaders for Judicial Misfits sitting on the Judicial Commission punished Anthony by gifting him with a complimentary censure.

As we speak (ca. August 2012) Anthony practices law in the Newburgh, New York area.
