Attorney Richard Wintory of Tucson, AZ; admitted perv, repeater

The state of Arizona presented Richard Mendel Wintory with a law license in 1984 after he graduated from the University of Oklahoma Law School.

FYI: This isn’t Dick’s First bite at the Attorney Misfit Apple Tree. He previously received a complimentary reprimand for engaging in a variety of misconduct. That report can be found by visiting the URL at the end of this article.

The Arizona State Bar found Dick guilty of engaging in the following misconduct.

  • Knowingly engaged in unprofessional conduct
  • Engaged in inappropriate communication with a client, while representing her (24 at the time) in a family court matter
  • Dick exchanged numerous inappropriate text messages with the client
  • Ultimately the client decided it was in her best interest to seek new counsel due to her concerns about the attorney-client relationship with the respondent
  • Commingled client funds with personal funds
  • Knowingly engaged in a conflict of interest with a current client

Here’s an example of the messages that Dick sent to the 24-year-old client.

First Message

  • “I have a selfish interest in making you feel crazy good. Without stress or strings.”
  • “Just the center of attention and focus, when and where work only for you.”
  • “I’m excited at the thought of you actually letting me tell you these things. But again, you’re in charge.” “And we can just stay on the boring lawyer stuff.”

Second Message

  • “I hope you’re having a 4th that beverages and inappropriate swimwear!”
  • “The client Definitely will include all of the above!”

Third message

  • “Aren’t you supposed to be at the pool keeping kids from drowning and looking fabulous?”

On July 5, 2022, Dick and his client attended a settlement conference involving her domestic case. Prior to the client leaving, Dick handed her a wrapped package that contained $1,200 cash and a note.” The note stated the following,

  • “So, here’s my idea. I just give you the dollars, no strings, expectations, obligations. You remain in complete control.”
  • “You have no reason to question whether my perv interest in you is *unknown word* by me trying to pressure, guilt or leverage you.”
  • “My conduct shows (I hope) the things I’ve said are true.”
  • “Now, whether you have interests is up to you. If you do, you can see I’m down w/that.”

As you can readily see, Dick finally admits that he’s a “perv.”

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Dick by gifting him with a complimentary reprimand.

It should be notedthat Dick has the chutzpah to declare on his State Bar information page that he typically bills an hourly rate of $300.00. However, he doesn’t disclose if there is a discount for female clients, preferably in their twenties.

And lastly, as one would suspect, Dick fails to mention the above misconduct and his prior suspension on his self-serving website at www.nextchapterlaw.net. Apparently, he chose to conceal this relevant information from prospective clients for the purpose of not limiting his future victim pool.

As we speak (ca. November 20123), Dick practices his so-called brand of law with The Next Chapter Family Law Center at 1 South Church Avenue in Tucson, Arizona.
