Attorney Earl Cherniak of Toronto; apologist for Judicial Misfits

 
Earl Cherniak was presented with a law license in 1960 after he graduated from the Osgoode Hall Law School of York University in Toronto.
 
At one time Earl was appointed as a so-called independent counsel to the Canadian Judicial Council (CJC) which is allegedly in the business of investigating and punishing Judicial Misfits.
 
In a June 8, 2012 article written by Christian Smith for the Lawyers Weekly, Earl was soundly criticized by a CJC inquiry committee for his failure to vigorously investigate and pursue misconduct charges against Judicial Misfits in Canada.
 
The panel opined that in various misconduct hearings Early may not have fully and forcefully presented the arguments for removing judges because he “may not have fully appreciated” that he was supposed to present the “strongest case possible” against the judges based on the evidence.
 
The CJC panel said that Earl’s conduct in not putting forth the strongest evidence sparked changes in its policy on the role of independent counsel. “There was a concern that independent counsel may not have fully appreciated that their role was to act as an advocate to present the against the judge,” the panel said.
 
Earl the Apologist responded to the criticism by saying, “I must say, I’m not amused. I completely reject the criticism of independent counsel” in its ruling. Obviously, Earl missed his calling as a standup comedian.
 
With buffoons (my apologies to buffoons) like Earl investigating Judicial Misfits in Canada, its not surprising that it is highly unusual when a judge is forcefully removed from the bench for engaging in egregious misconduct.
 
Apparently when Earl went to law school, he skipped the classes that fully explained what an “advocates” role really was.
 
As we speak (ca. July 2012) Earl is employed by the Lerner Commercial Litigation Group at 130 Adelaide Street West in Toronto, Canada.
