Former Judge Erika Martin of Manchester, NY; serial convicted thief

 

The New York Commission on Judicial Conduct found Erika guilty of engaging in the following misconduct, all of which took place while she was employed as a Justice of the Manchester Town Court, Ontario County.

 

FYI: In addition to being employed as a Justice of the Manchester Town Court, Erika operated a business known as Pazzo Bella Salon and Spa.

  • Erika was charged with the offense of Grand Larceny in the Third Degree, a class D felony, pursuant to a felony complaint alleging that between January 1, 2016, and December 16, she stole in excess of $3,000 in court funds from the Town of Manchester
  • Engaged in a scheme to Defraud in the First Degree, a class E felony, alleging that in March 2016 she engaged in a check-kiting scheme and thereby obtained monies in excess of one thousand dollars that she did not have in her M&T Bank business account associated with Pazzo Bella Salon and Spa, and from her personal accounts at M&T Bank, Citizens Bank and ESL Federal Credit Union
  • Charged with Grand Larceny in the Fourth Degree, a class E felony, alleging that between January 15, 2016, and July 19, 2016, she stole property through her M&T Bank business account in excess of one thousand dollars, to wit $1,166.00
  • Charged with four counts of Petit Larceny, all class A misdemeanors,
  • Charged with two counts of Issuing a Bad Check, both class B misdemeanors, alleging that on or about December 26, 2016,she wrote two checks on her closed personal account with ESL Federal Credit Union, knowing that she did not have sufficient funds to cover the checks.
  • Subsequently, pled guilty to three charges: Grand Larceny in the Third Degree, a class D felony, , Scheme to Defraud in the First Degree, a class E felony, and Petit Larceny, a class A misdemeanor
  • Failed to act with due diligence (slacker)
  • Failed to uphold the integrity and independence of the judiciary by failing to maintain high standards of conduct so that the integrity and independence of the judiciary would be preserved
  • Failed to avoid impropriety and the appearance of impropriety
  • Failed to respect and comply with the law and failed to act in a manner that promotes public confidence in the integrity and impartiality of the judiciary
  • Failed to perform the duties of judicial office impartially

Rather than wait for a ruling from the Judicial Conduct Commission, Erika did what most cowardly Judicial Misfits do, she resigned from the bench and promised he would never seek judicial office in the future.

 

As we speak (ca. September 2023), it is rumored that Erika has an application pending as a greeter at the Walmart Supercenter Store located at 4238 Recreation Drive in Canandaigua, New York.
