Attorney Mark Wesbrooks of Peoria, AZ; ethical goblin

The state of Arizona presented Mark Wesbrooks with a law license in 1997 after he graduated from St. Mary’s University School of Law.

The Arizona State Bar found Mark guilty of engaging in the following misconduct.

• After taking over representation of a personal injury case from prior counsel, the case settled a few weeks later for $250,000
• Mark retained 40% ($100,000) of the settlement funds as his fee
• Mark also retained a portion of the settlement funds to pursue a potential legal malpractice action against prior counsel
• Mark took actions consistent therewith on the clients’ behalf, despite not having a signed fee agreement for such a case
• Mark also retained disputed funds from the clients’ matter in his trust account for over two years
• Commingled client funds with personal funds
• Failed to train and supervise office staff
• Misconduct involved multiple offense
• Victims of Marks misconduct were especially vulnerable
• Knowingly bypassed required trust account rules

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Mark by gifting him with a complimentary reprimand and assessed investigative costs of $1,462.50.

And lastly,as one would suspect, Mark fails to mention the misconduct set forth above on his self-serving website at www.wesbrookslaw.com. Apparently, he chose to conceal this relevant information from prospective clients for the purpose of not limiting his future victim pool.

As we speak (ca. September 2023), Mark practices his so-called practice of law with the Wesbrooks Law Firm PLLC at 15396 North 83^rd Avenue in Peoria, Arizona.
