Attorney Joseph Westmeyer III of Toledo, OH; cheating loser

 

The state of Ohio presented Joseph William Westmeyer III with a law license in 1999 after he graduated from the University of Toledo School of Law.

 

FYI: Joseph William Westmeyer III is the grandson of Joseph Westmeyer Jr. who had his license suspended for defrauding a client out of nearly $70,000.00. For further information regarding the misconduct of Joey Jr., visit the URL at the end of this article. This only further proves that the Avocado doesn’t fall far from the tree.

 

The Toledo Bar Association found Joey guilty of engaging in the following misconduct.

  • Failed to pay Dr. Schwartz his charges of $4,296.00 in spite of providing the doctor with a letter of protection in regard to any settlement of his client Malik Meyers matter
  • The settlement amounted to $15,000 and Joey’s promise to Dr. Schwartz legally bound him to pay Schwartz the $4,296.000 medical bill
  • Failed to disclose in the closing settlement statement the amount that was to be paid to Dr. Schwartz from the settlement proceeds
  • Failed to promptly deliver to Dr. Scwartz funds he was lawfully entitled to receive
  • Failed to render a full accounting regarding said settlement funds
  • Engaged in conduct involving fraud, deceit, dishonesty, or misrepresentation
  • Lied that he had made some manner of payment to dr. Schwartz
  • In his representation of Annette Hicks involving a car accident, Joey singed a “letter of protection” in which Joey and his clients agreed Dr. Schwartz would be paid out of the proceeds of any settlement or judgment
  • Ms. Hicks received chiropractic treatment with Dr. Schwartz, accumulating charges of $4,794.00
  • After settling Ms. Hicks’ case, Joey paid himself $5,833.00 in fees, but failed to pay anything to Dr. Scwartz
  • Failed to prepare closing settlement statement pursuant to the contingent fee agreement he had with Ms. Hicks
  • Failed to accurately reflect the amounts disbursed as detailed on the settlement statements signed by his clients
  • Joey represented Kaitlyn Mount in a pedestrian/truck accident case that later settled for $100,000.00
  • From December 2019 through September 2021, Ms. Mount made numerous requests to Joey for status updates on medical provider claims and the status of liens, and when distribution of the settlement proceeds might be expected; however Joey did not provide any meaningful response
  • After Joey’s repeated refusals to contact her, Ms. Mount fired him and hired attorney Richard Cuneo to assist her as to the whereabouts of the $100,000 and status various medical provider liens
  • It took several contacts from Mr. Cuneo to Joey before he responded by stating he had paid himself $33,333.30 from the $100,000 settlement; however he failed to return Ms. Mount’s file to Cuneo
  • Failed to keep Ms. Mount informed of the status of her matter
  • Failed to comply with information requests from Ms. Mount
  • Failed to act with due diligence in his representation of Ms. Mount
  • Failed to proceed with reasonable diligence in Ms. Mount’s disability claims
  • Commingled client funds with personal funds
  • Failed to take reasonable steps to protect Ms. Mount’s interest upon being terminated
  • Failed to fully cooperate with ethics investigators (Screw you, said Joey!)
  • Failed to maintain professional liability insurance
  • Failed to inform the clients aforementioned herein that he did not maintain legal malpractice insurance ‘
  • Failed to maintain a record for each client on whose behalf he held funds
  • Failed to perform monthly reconciliations of client trust accounts

All that remains now is to see what if any punishment is meted out to Joey by the apologists for Attorney Misfits sitting on the Oho Supreme Court.

 

As we speak (ca. August 2023), Joey practices his so-called brand of law with the Westmeyer Law Offices at 421 North Michigan Avenue in Toledo, Ohio.
