Solicitor Stuart Bain of Scotland; ethical troll

 

The Law Society presented Stuart Bain with a law license in 1986 after he graduated from the University of Glasgow School of Law.

 

The Scottish Solicitors’ Discipline Tribunal found Stu guilty of the following misconduct.

  • Engaged in professional misconduct
  • Failed to disclose to the Secondary Complainer’s solicitor that there were outstanding works in relation to the roof, fabric and pointing of the property
  • Stu knew that the information which his client had given him and which was contained in the missives was false
  • Stu’s conduct called into question his integrity
  • Failed to withdraw from acting on behalf of his client when he became aware that his client had given him false information
  • Continued to represent his client who had instructed Stu not to disclose the correct position to the Secondary Complainer’s solicitor

As a direct consequence of his misconduct, the enablers for Solicitor Misfits sitting on the Discipline Tribunal punished Stu by gifting him with a complimentary censure and imposed a fine of £3,000.

 

And lastly, as one would suspect, Stu fails to mention the misconduct set forth above on his self-serving website at www.andersonbain.co.uk.  Apparently, he decided to conceal this relevant information from prospective clients so that he would not limit his future victim pool.

 

As we speak (ca. February 2023), Stu practices his so-called brand of law with Anderson Bain LLP at 10 Thistle Street in Aberdeen, Scotland.
