Judge Alois W. Kraker of Greenville, NY; slacker, loser

The New York State Commission on Judicial Conduct found Judge Kraker guilty of engaging in the following misconduct.

• Failed to discharge his administrative responsibilities diligently (slacker)
• Failed to disclose that the plaintiff was a customer of respondent’s auto business or to disqualify himself
• Failed to administer an oath or affirmation to the pro se litigants and witnesses
• Made a series of rude and undignified comments to a defendant, which conveyed an impression of bias against him
• Failed to properly supervise his court clerk by allowing her to interject repeatedly into a court proceeding
• Failed to admonish a spectator who interjected into the proceeding with his own opinion
• Engaged in an ex parte [one-sided] conversation about the substance of a case with the plaintiff’s witness and a spectator, during which respondent denigrated the defendant
• Failed to disclose that the owner of the defendant business was a Greenville Town Council member and a
• business associate of his
• Failed to report the receipt of court monies to the State Comptroller in a timely manner as the law required

As a direct consequence of his misconduct, the apologists for Judicial Misfits sitting on the Judicial Commission punished Judge Kraker by gifting him with a complimentary reprimand.
