Attorney Richard Daily of Arvada, CO; repeat offender

 

The state of Colorado provided Richard Wescott Daily with a law license in 1971 after he graduated from the University of Colorado School of Law.

 

The Colorado State Bar found Dick guilty of engaging in the following misconduct.

 

Dick’s 1st bite at the Attorney Misfit Apple Tree

  • Failed to keep a client reasonably informed about a matter
  • Failed to promptly comply with reasonable requests for information 
  • Failed to refund advance fees upon termination of representation
  • Misrepresented [lied] to his clients that he was safeguarding the $10,000.00 fee in the settlement fund trust account pending completion of the audit
  • Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation

As a direct consequence of her misconduct, the enablers for Attorney Misfits sitting on the Colorado Supreme Court punished Dick by gifting him with a complimentary 1-year suspension of his law license. 

 

Dick’s 2nd bite at the Attorney Misfit Apple Tree

  • Failed to inform his client about his receipt of interim estate distributions
  • Failed to comply with his client’s request for an accounting of estate distributions
  • Never provided written disclosure of the basis for his fees
  • Dick used the funds, in which both he and his client claimed an interest, without providing an accounting or waiting for a severance of their interests
  • Neglected to inform his client about a trial date
  • Failed to appear at a pre-trial conference, causing default judgment to be entered against his client Failed to move to set aside the default or reimburse his client for wages garnished as a result of the default
  • Refused to respond to his client’s numerous communication attempts

As a direct consequence of her misconduct, the enablers for Attorney Misfits sitting on the Colorado Supreme Court punished Dick by gifting him with a complimentary 30-day suspension of his law license. 

 

As we speak (ca. June 2022), Dick practices his so-called brand of law at 5580 Brentwood Street in Arvada, Colorado.
