Judge Don R. Emerson of Amarillo, TX; ethical dwarf

 
The state of Texas provided Don Rexford Emerson with a law license in 1973 after he graduated from the University of Houston Law School.
 
For the last 27 years, Don has had his significant snout firmly implanted in the public trough. Don was appointed to the bench on the 320th District Court in Potter County in 1985. Thereafter, he succeeded in duping the voters into electing him several times.
 
During his tenure on the bench, the Texas Judicial Commission charged Judge Emerson with the following misconduct.
 
Don used favoritism when making appointments of attorneys in criminal cases for indigent defendants. Over a two year period of time, 38 attorneys received appointments from Donnie. However, attorneys Paul Herrmann (former prosecutor in Don’s court), Laura Hamilton and Wal Weaver received 45% of all the criminal court appointments. Those appointments and earnings are as follows:
  • Herman – 289 appointments for $118,900 in attorney fees
  • Weaver & Hamilton – 334 appointments for $142,199 in attorney fees
Donnie also failed to follow established court rules and practices when he removed all new family law and juvenile cases from the statutory county court. He used his position as the local administrative judge to effectively manipulate the court system to afford certain family law attorneys a more favorable forum for their clients.
 
As a consequent of his misconduct, the cheerleaders for Judicial Misfits sitting on the Texas Supreme Court punished Donnie by gifting him with a complimentary Public Warning.
 
This clown (my apologies to clowns) should have been removed from the bench for abusing his office to financially reward his friends and/or associates.
 
As we speak (ca. June 2012) the Dishonorable Don Emerson continues to sit as a judge in the District Court in Amarillo.
