Attorney Nicholas Fortuna of New York City; ethical goblin

The state of New York presented Nicholas Joseph Fortuna with a law license in 1987 after he graduated from Touro University School of Law.

The 1^st Appellate Division Grievance Committee found Nicky guilty of engaging in the following misconduct.

• Engaged in conduct adversely reflecting on fitness to practice
• Commingled client funds with personal funds
• Misappropriated [stole] client and third-party funds
• Failed to maintain intact client and third-party funds held in his Citibank escrow account incident to his practice of law
• Permitted the balances of client/third-party funds to fall below the amount required to be maintained therein for the
• benefits of said clients and third parties
• Failed to make accurate entries of all financial transactions in his firm’s special account, in his firm’s records of
• receipts and disbursements, in a ledger book or similar record, or other books of account kept in the regular course of business

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Grievance Committee punished Nicky by gifting him with a complimentary censure.

And lastly, as one would suspect, Nicky makes no mention of his misconduct as set forth above on his self-serving website at www.allynfortuna.com. Apparently, Nicky decided to conceal this information from prospective clients for the purpose of not limiting his future victim pool.
