Judge Barbara R. Kapnick of New York City; One of the Good Gals

 

The state of New York provided Barbara R. Kapnick with a law license in 1980 after she graduated from the State University of New York at Buffalo  (SUNY) School of Law.

 

In a recent (ca. June 2021), Judge Kapnick was a member of a committee that entered an order suspending the law license of Rudy Giuliani for his egregious misconduct in performing in lying about Joe Biden’s electoral victory in November 2020.

 

In her ruling to suspend Rudy’s law license, Judge Kapnick made the following findings of fact.

  • “Rudy communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020.”
  • “Rudy’s conduct immediately threatens the public interest and warrants interim suspension from the practice of law.”
  • “Rudy’s false statements were made to improperly bolster his narrative that due to widespread voter fraud, victory in the 2020 United States presidential election was stolen from his client [Trump].”

The Rules of Professional Conduct that Rudy violated relating to the suspension order is as follows.

  • Knowingly made a false statement of fact or law to a tribunal
  • Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
  • Knowingly made a false statement of fact or law to a third person [public at large]
  • Engaged in conduct adversely reflecting on Rudy’s fitness as a lawyer

Kudos to Judge Kapnick for displaying the courage and fortitude to vote to suspend a so-called attorney who believes he has an absolute right to lie and in the process foment anarchists to try and overthrow the government on January 6, 2021.

 

As we speak (ca. September 2021), Judge Kapnick continues to sit as Justice of the New York Supreme Court in New York, New York.
