Re: Ethics complaint v. Chief Justice Maureen O’Connor

 

Dear Mr. Caligiu:

 

The following ethics complaint deals with the unethical conduct, misfeasance in performance of official duties, and violations of the Ohio Constitution, Supreme Court Rules on the Assignment of Judges and Code of Judicial Conduct, all of which are dealt with under separate headings as set forth below with Tables setting forth details of said misconduct at the end of the complaint.

 

As you’ll see from the Tables set forth herein, I have documented seven-hundred-thirty-eight (738) instances wherein Chief Justice O’Connor violated her oath of office while assigning retired visiting judges to sit on various courts throughout Ohio from January 2011 to July 2021. It would take frivolity to new and yet unseen levels for Chief Justice O’Connor to plead ignorance regarding her serial violations of the constitution, rules of court, and the Rules of Judicial Conduct.

 

Morever, these assignments were unconstitutional and/or violated Supreme Court rules, something that both the Chief Justice and the assigned judge clearly knew or were dutybound to know.

 

Every week your office disciplines lawyers and judges who violate their duties imposed by the Code of Professional Responsibility, and to the best of my knowledge you have never vindicated one because of claimed ignorance of the rules and/or the law. In fact, if anyone had the chutzpah to make such an argument the consequences would likely be even worse.

 

The compensation paid and received by these judges must be deemed improper/illegal and said judges should be made to reimburse the State in full. The question of interest being applied to said payments is another matter that will need to be addressed. Of concern is also the question of whether rulings issued by these judges can withstand judicial review and/or legal disputes by losing litigants due to these illegal/improper assignments.

Unfortunately, pursuant to my ongoing investigation, there are many more instances of unethical conduct and/or misfeasance in office involving the conduct of Chief Justice O’Connor that will need to be addressed and brought to your attention in the not-too-distant future. 

 

And lastly, since these assignments were unconstitutional and/or violated Supreme Court rules, something that both the Chief Justice and the assigned judge clearly knew or were dutybound to know, the compensation paid and received by these judges must be deemed improper/illegal and said judges should be made to reimburse the State in full. The question of interest being applied to said payments is another matter that will need to be addressed. Of concern is also the question of whether rulings issued by these judges can withstand judicial review and/or legal disputes by losing litigants due to these illegal/improper assignments.

 

A. Violations of the Code of Judicial Conduct

 

Canon 1

A judge shall uphold and promote the independence, integrity, and impartiality of the judiciary, and shall avoid impropriety and the appearance of impropriety.

 

Rule 1.2 Promoting Confidence in the Judiciary

[5]Actual improprieties include violations of law, court rules, or provisions of this code

 

Canon 2

A judge shall perform the duties of judicial office impartially, competently, and diligently.

 

 

Violating the Ohio Constitution and Supreme Court Rules Governing the Assignment of Judges a minimum of 738 times would certainly raise serious questions as to the competency of Chief Justice O’Connell.

 

B. Constitutional Violations on Assigning Judges to sit on Supreme Court

 

Art. IV Sec. 2 and Sec. 5 of the Ohio Constitution places legal constraints on Chief Justice O’Connor for the assignment of judges to sit on the Ohio Supreme Court by limiting said assignments to sitting appellate court judges. (See Art. IV, Sec. 2 and 5)

 

The Supreme Court Guidelines for Assignment of Judges Sec. 4 Levels of Assignment 4.01(C) also only allows for a sitting court of appeals judge to sit on the Supreme Court. (See Guidelines at https://tinyurl.com/sku3x99a)  

 

Sec. 4.02 Levels of Assignment of Retired Judges does not allow for the assignment of a retired common pleas or retired appellate judge to sit on the Ohio Supreme Court.

 

Despite said constitutional prohibitions, Chief Justice O’Connor illegally made one hundred (100) assignments involving twenty-one (21) retired Common Pleas Judges and 40 assignments involving five (5) retired Appellate Judges to sit on the Ohio Supreme Court. (See Tables B and C)

 

In one matter,Chief Justice O’Connor illegally assigned retired Franklin County Common Pleas judge Dale Crawford to the Supreme Court on an astounding thirty-five (35) times. Additionally, the Chief Justice engaged in the same illegal conduct when she assigned retired 10th District Court of Appeal Judge Patrick McGrath thirty-five (35) times. (See Tables B and C)

 

B.Violation of 13 Week Assignment of Visiting Judge Prohibition

 

“Except in exigent circumstances, the Chief shall not assign a retired judge to serve as an assigned judge until thirteen weeksafter the date the judge left judicial service as a sitting judge.”

 

The most relevant application of the term “shall”  its inclusion in the Ohio Rules of Professional Conduct at 8.3 “Reporting Professional Misconduct”, which states that an attorney “shall” inform a disciplinary authority if he/she possesses unprivileged knowledge of a violation of the Rules committed by another attorney or more importantly that of a judge.

 

The U.S. Supreme Court in Kingdom Technologies, Inc. v. United States(754 F.3d 923) specifically ruled that 38 U.S.C. §8127(a) involving Veterans Affairs contracts that included the language that a contracting officer “shall award contracts” ruled that the word “shall” was mandatory and not discretionary.

 

Table Abelow establishes CJ O’Connor violated the 13-week prohibition against assigning retired judges on three-hundred-twenty-eight (328) separate occasions. It would take frivolity to knew and yet unseen levels for the Chief Justice to proclaim she was unaware of her misdeeds.

 

Additionally, Table B below sets forth the twenty-four (24) times that CJ O’Connell executed assignments with effective dates that were the same as the judge’s retirement from the bench. Table C lists nineteen (19) retired judges who were provided with assignments by the Chief Justice one (1) day after they retired.

 

And lastly, in addition to the highly unethical conduct set forth above, I believe that CJ O’Connor’s conduct is in violation of the Ohio Code of Judicial Conduct, which is addressed below.

 

C. Improper/Illegal Backdating of Judicial Assignments

 

Chief Justice O’Connor assumed her office on January 11, 2011. Therefore, she could not lawfully assign any judge with an effective date of said assignment until after she was sworn in on the 11th of January. Despite this constitutional prohibition, my review to date (See Table C) shows that she backdated assignments with effective dates of January 1, 2011, on two-hundred-thirty-eight (238) times and did so on forty-eight (48) with backdating taking effect between January 3 and January 7, 2011. (See Table D)

 

I am confident that the true number of improper/illegal backdating of assignments by the Chief Justice could well surpass 300 or more; however, I cannot afford to spend another two weeks or so investigating the matter.
