Judge David Brougham of Pomona, CA; incompetent boob

The state of California provided David C. Brougham with a law license in 1988 after he graduated from Pepperdine University School of Law.

FYI:Former Gov. Arnold Schwarzenegger was duped into appointing Derek as a Los Angeles County Superior Court judge in 2008. Davey didn’t receive the appointment because he was the most qualified attorney in the greater Los Angeles area. He received it because he had proven to be a reliable lackey for the local political hacks.

It should be notedthat Davey has had his significant snout firmly implanted in the public trough for the past thirty-three (33) years. Apparently, no self-respecting law firm in the greater Los Angeles area was about to offer Davey a good paying job.

In one matter,Davey presided over the criminal case of People v. Yang. During the jury selection process, the prosecutor rejected four out of five prospective jurors were Asian. Based on this conduct Yang’s attorney objected to Davey’s conduct in failing to properly conduct a Batson/Wheeler motion to determine if the rejection of mainly Asians from the jury pool was unconstitutional.

Subsequently, Yang’s attorney filed an appeal with Division Eight of the Court of Appeal regarding Davey’s conduct. In reversing Davey’s display of total incompetence, the appellate court made the following statements in its reversal order.

• “The prosecutor had stricken 80 percent (4/5) of the Asian-American prospective jurors seated for questioning.”
• “The record also shows that the prosecutor used four out of its first six peremptory challenges against Asian-American jurors, that is 66 percent (4/6).”
• Thus, the prosecutor’s use of her peremptory challenges [without proving cause] was disproportionate.”

Sadly, this is the kind of jurisprudence you get when someone of Davey’s incompetence in the law is appointed because of his political connections rather than on merit.

It goes without saying that Davey doesn’t much give a damn when he’s overturned (rebuked in truth) by the appellate court since he is well aware that no California judge has ever been tossed off the bench for being an incompetent boob.
