Attorney Thomas Fendick of Warsaw, NY; convicted felon, repeat offender

 

The state of New York provided Thomas John Fendick with a law license in 1985 after he graduated from Hofstra University School of Law.

 

The Grievance Committee of the 5th Judicial Department found Tommy guilty of engaging in the following misconduct.

 

Tommy’s 1st bite at the Attorney Misfit Apple Tree

  • Engaged in conduct that adversely reflects on his fitness as a lawyer
  • Failed to decline representation when required to so act
  • Entered into a business transaction with a client involving conflict of interest
  • Failed to disclose terms of business transaction with the client in writing
  • Failed to obtain written consent from the client regarding the financial transaction as to his inherent conflict of interest

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Grievance Committee punished Tommy by gifting him with a complimentary censure.

 

Tommy’s 2nd bite at the Attorney Misfit Apple Tree

  • Convicted of making a false statement to a federally insured financial institution, a felony
  • Obtained a loan in the amount of $915,000 to build a home in Florida, defaulted on the loan, and the bank holding the mortgage commenced a foreclosure proceeding
  • Induced bank to agree to a short sale of the property by falsely certifying that the sale was an arm's length transaction and that all relevant agreements or understandings had been disclosed to the bank when, in fact, Tommy had arranged for his business associate to act as a straw purchaser with the understanding that Tommy would be permitted to continue to reside at the premises and that the deed would be subsequently transferred to a family member of Tommy’s
  • Because of Tommy’s scam the bank suffered a loss of $529,959

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Grievance Committee punished Tommy by gifting him with a complimentary 4-year suspension of his law license.

 

As we speak (ca. June 2021), Tommy practices his so-called brand of law at 52 North Main Street in Warsaw, New York.
