Judge John D. Kirihara of Merced, CA; slacker, serial perjurer

John d. Kirihara succeeded in duping the voters in Merced County into electing him as a Superior Court Judge in November 2000. He successfully duped them again in 2009.

The California Commission on Judicial Performance found Judge Kirihara guilty of the following misconduct in early 2012.

The law in California requires all judges to render decisions in pending cases within 90 days. In the following court cases, Johnny failed to follow the law.
  1. 230 days to rule in Rodrigues v. CVP Acquisition Corp.
  2. 237 days to rule in the Estate of Vernon E. Lustre
  3. 110 days to rule in the Petition of Family Trust of Ray Buie
Johnny’s False (Perjured) Affidavits

The Calfiornia Constitution provides that a judge many not receive a salary “while any cause before the judge remains pending and undetermined for 890 days after it has been submitted for decision.” (Cal. Const., art. VI, § 19) To be paid, the judge must sign an affidavit to that effect.

The Commission ruled that Johnny submitted eleven (11) salary affidavits that falsely stated that no cause remained pending and undetermined that had been submitted to him for decision. As a consequence of his false affidavits, Johnny received his judicial salary in violation of California law.

As a consequence of his misconduct, the cheerleaders for Judicial Misfits sitting on the Judicial Commission punished Johnny the Perjurer by gifting him with a complimentary admonishment.

Because Judicial Misfits are held to a much lower standard of conduct then everyone else in California, Johnny was never criminally charged or prosecuted for committing perjury on 11 occasions.

Sure is comforting for Californians to know that there is yet another criminal sitting in judgment of them and/or there fellow citizens. Isn’t California a great country?

As we speak (ca. May 2012) Johnny continues to sit as a Superior Court judge in Merced, California.
