Judge Mark DiVietro of Owasco, NY; ethical troll

The state of California presented Mark A. DiVietro (MAD) Elaine W. Mandel with a law license in 1971 after he graduated from California Western University School of Law.

The New York State Commission on Judicial Conduct found Mark guilty of engaging in the following misconduct.

  • Engaged in illegal ex parte communications with a criminal defendant
  • Harassed two women
  • Repeatedly sent text messages to his then girlfriend that contained threats about a former girlfriend
  • Many of Mark’s text messages were vulgar, crude, demeaning and/or featured extreme gender-based slurs and profanity
  • During a defendant’s appearance in court, Mark gave the defendant personal advice about how to avoid having his firearms confiscated by law enforcement authorities

Rather than await punishment that may have led to him being tossed off the bench, Mark did what any respectable coward would do, he resigned and agreed to never pursue a judicial position in New York for the balance of his miserable  life.

As we speak (ca. April 2021), it is rumored that Mark has applied for a job as a greeter at the Walmart Supercenter Store located at 297 Grant Avenue in Auburn, New York.
