Former Judge Frank Van Gundy of Deming, NM; ethical goblin

 

The Judicial Standards Commission found Frankie guilty of engaging in the following misconduct.

  • Violated a defendant’s due process right
  • Due process violation led to defendant being held at the Luna County Detention Center for 141 days
  • Ordered jailing of defendant even though he knew the defendant was mentally incompetent
  • Failed to provide an original signature on the court’s Judgment and Sentence orders as required by the relevant court rules

As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the New Mexico Supreme Court punished Frankie by gifting him with a complimentary censure.

 

Apparently, Frankie is of the opinion that “due process” is the means by which the grass becomes moist in the am.

 

Fortunately for the citizens in the greater Deming and Luna County area, Frankie decided to resign from the bench in late 2020.

 

As we speak (ca. March 2021), it is rumored that Frankie has accepted a job as a greeter at the Walmart Supercenter Store located at 1021 East Pine Street in Deming, New Mexico.
