Attorney Matthew McCollister of Lake Elmo, MN; half-wit, serial offender

 

The state of Minnesota presented Matthew David McCollister with a law license in 2009 after he graduated from Hamline University School of Law.

 

The Office of Lawyer Regulation found Matty guilty of engaging in the following misconduct.

 

Matty’s 1st bite at the Attorney Misfit Apple Tree

  • Improperly referred potential client to a lawyer outside his firm
  • Received payments of referral fees without remitting said fees to his firm
  • Engaged in conduct involving fraud, deceit, dishonesty, or misrepresentation

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Minnesota Supreme Court punished Matty by gifting him with a complimentary 30-days suspension of his law license and assessed investigative costs of $900.00.

 

Matty’s 2nd bite at the Attorney Misfit Apple Tree

  • Agreed to a settlement without the client's knowledge or consent
  • Forged a client’s name on settlement agreement
  • Made false statements to opposing counsel about settlement agreement
  • Neglected legal matter entrusted to him
  • Failed to communicate with his clients

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Minnesota Supreme Court punished Matty by gifting him with a complimentary 90-days suspension of his law license.

 

Matty’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to provide competent representation (half-wit)
  • Failed to act with due diligence (slacker)
  • Incompetence led to client’s personal injury claim expiring under the applicable statute of limitations
  • Failed to convey a settlement offer to his client
  • Failed to inform client statute of limitations had expired on is personal injury claims
  • Failed to communicate with several clients
  • Failed to obtain client’s consent to dismiss a petition for arbitration of no-fault benefits
  • Failed to explain scope of representation to a client
  • Failed to identify in written contingent fee agreement now costs and expenses would be calculated
  • Knowingly made false statements to a client
  • Knowingly lied to ethics investigators (Up yours, said Matty!)

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Minnesota Supreme Court punished Matty by gifting him with a complimentary 2-year suspension of his law license.

 

As we speak (ca. February 2021), Matty practices his brand of law with Padden & McCollister PLLC at 8647 Eagle Point Blvd in Lake Elmo, Minnesota.
