Attorney Duane Kennedy of Rochester, MN; ethical ogre, repeat offender

The state of Minnesota presented Duane A. Kennedy with a law license in 1976 after he graduated from Hamline University School of Law.

The Office of Lawyer Regulation found Duane guilty of the following misconduct.

Duane’s 1^st bite at the Attorney Misfit Apple Tree

• Engaged in a conflict of interest
• Represented defendant in criminal matter at same time he represented witness in the same matter
• Engaged in conduct prejudicial to the administration of justice

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Minnesota Supreme Court punished Duane by gifting him with a complimentary reprimand.

Duane’s 2^nd bite at the Attorney Misfit Apple Tree

• Offering to have his client, a complainant in a criminal sexual conduct case, act more favorably for the defendant as a witness in the defendant’s criminal case if the defendant paid the client to settle his civil claims against her
• Engaged in conduct prejudicial to the administration of justice
• Violate or attempted to violate the Rules of Professional Conduct, knowingly assisted or induced another to do so, or did so through the acts of another

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Minnesota Supreme Court punished Duane by gifting him with a complimentary 30-day suspension of his law license.
