The following ethical dilemma appeared on a recent Kansas Judicial Commission approved ethical exam.
  • As the result of  imposing a fine against a defendant regarding a traffic offense, you advise the defendant he will be fined $100. 
  • The defendant reaches in his pocket and hands you what he believes is a crisp $100 bill.
  • Shortly after the defendant leaves the courtroom, you realize that there was really two (2) $100 bills that were stuck together.
The ethical question is as follows:
  • Do you as the Judge have to report and turn over the extra $100 bill to the clerk of court and/or the administrative office?
