The following ethical dilemma appeared on a recent Wyoming Bar Association approved bar exam.
  • As the result of a consultation with a client an attorney advised the client that the fee will be $100.
  • The client reaches in his pocket and hands the attorney what he believes is a crisp $100 bill.
  • Shortly after the client leaves the office, the attorney realizes that there was really two (2) $100 bills that were stuck together.
The ethical question is as follows:
  • Does the attorney have to tell his partner about the extra $100 bill?
