U.S. Judge Juan Perez-Gimenez of Puerto Rico; incompetent boob


The Commonwealth of Puerto Rico presented Juan Manuel Perez-Gimenez with a law license in 1957 after he graduated from the University of Puerto Rico School of Law.


Former President Jimmy Carter was duped into nominating Juan as a U.S. District Court judge in 1979. Juan didn’t receive the appointment because he was the most qualified attorney in Puerto Rico. He received it because he had proven to be a reliable lackey for the local political hacks.


It should be noted that Juan assumed senior status in July 2006. This means that he is only required to work twenty-five (25) hours a week and still collect a fully salary of $199,100 a year. Wouldn’t you love to have your work week cut by 75% and still receive your full salary along with fully paid health insurance benefits? I thought you would! Unfortunately, you can only take umbrage with the fact that you’re paying for this obscene largess.


In one matter, Juan presided over a case wherein Michelle Maloy’s lawsuit claimed that the Puerto Rico Real Estate Examining Board denied her a license in retaliation for her public criticism of the Board, thereby violating her free speech rights under the First Amendment of the United States Constitution.


In an effort to further establish that he’s an incompetent loser, Juan ignorantly dismissed Michelle’s lawsuit in favor of the Puerto Rico Real Estate Examining Board


Subsequently, Michelle’s attorney appealed Juan’s asinine dismissal of her case to the U.S. Court of Appeals for the First Circuit. That court ruled that Juan’s dismissal was erroneous in that Michelle’s complaint stated a plausible claim under U.S. Law. The Court then vacated Juan’s ignorant ruling of dismissal.


In vacating Juan’s moronic dismissal of Michelle’s case, the Court of Appeals stated in part:

  • “We take as true the facts presented in her complaint and draw all reasonable inferences in her favor.”
  • “ Indisputably, Maloy's allegations are adequate, if believed, to show that she engaged in constitutionally protected activity [free speech].”
  • “Maloy testified publicly about alleged government corruption [involving the Puerto Rico Real Estate Examining Board], a quintessential exercise of the rights to speak freely and to petition the government.”

The Appeals Court then ordered that Juan’s dismissal be vacated and that Michelle’s case proceed.


Of course Juan doesn’t much give a damn if his asinine/incompetent rulings are reversed on Appeal because it doesn’t cost him anything financially and he knows for a fact that no federal judge has ever been removed/impeached for being incompetent.


As we speak (ca. March 2019), Juan continues to sit as a U.S. District Court judge for the District of Puerto Rico in San Juan, Puerto Rico.
