Attorney Kelly Booth of Park City, UT; lying slacker

The state of Utah presented Kelly Ann Booth with a law license in 2006 after she graduated from the University of Utah School of Law.

The Ethics and Discipline Committee of the Utah Supreme Court found Kelly guilty of the following misconduct.

• Failed to act with due diligence (slacker)
• Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
• Filed lawsuit against several defendants, one of whom advised Kelly that although his name was similar to a named defendant, he was not the same person named in the lawsuit
• Despite being informed by a wrongfully named defendant, Kelly continued to pursue him and eventually obtained a default judgment against him and then garnished money from his personal bank account
• Wrongfully pursued defendant, forced to hire attorney to bar garnishment and subsequently the court granted the motion and ordered Kelly to pay his attorney fees
• Lied to client that trial had been cancelled because of a pending summary judgment motion
• Failed to keep client informed of matters in the case
• Despite winning default judgments against several defendants, never took any action to collect on said judgments on behalf of her client

As a consequence of her misconduct, the apologists for Attorney Misfits sitting on the Utah Supreme Court punished Kelly by gifting her with a complimentary stayed 12-month suspension of her law license.

In truth, the comedians sitting on the Utah Supreme Court didn’t mete out any meaningful punishment to Kelly.
